The legislative threat to the private investigation industry has never been more diffuse — or more serious. Working PI Magazine published the definitive watchlist — "5 Bills That Can Kill," authored by Matthew Spaier, President of Satellite Investigations.


The 5 Threats


National Data Privacy Legislation — Federal laws modeled on CCPA would restrict PI access to commercial databases. 20 states now have comprehensive privacy laws, up from 13 in 2025.


Independent Contractor Reclassification — Federal ABC Test adoption would force solo PIs into employee status.


Public Records Restrictions — States narrowing access to criminal history and financial records.


Federal Data Retention Mandates — Could complicate PI access to historical records.


Restrictions on Surveillance Tools — Proposed limits on drones, GPS trackers, and cameras without consent.


Spaier makes a compelling case for
NCISS membership as the primary legislative defense.


Other Bills to Watch


California AB 2049 Advanced to committee February 18. Would prohibit PI firm employees from carrying BB devices without prescribed training. Non-compliance classified as a crime.


South Carolina H 4141 — Would add a fourth pathway to PI licensure: three years of military investigative experience.
